CANADIAN CLUB GUIDED CAMPING TRIP TO CANADA WINTER 2024 PROMOTION

TERMS AND CONDITIONS

  1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over who can travel to Vancouver, Canada during 04/08/2024 and 19/09/2024.
  3. Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into the promotion open on 01/03/2024 and close at 11:59pm AEDST on 30/04/2024 (“Promotional Period”).
  5. A Participating Venue will not offer this promotion as an inducement directed at encouraging patrons to gamble in line with relevant state gambling authorities
  6. A “Participating Venue” is any on-premise licenced venue in Australia that advertises the promotion and stocks the Eligible Product (defined below) during the Promotional Period.
  7. To be eligible to enter, individuals must purchase, in a single transaction, two Canadian Club draughts (“Eligible Product”) from a Participating Venue during the Promotional Period (“Qualifying Transaction”) and obtain a promotional flyer. If a flyer is not handed to the individual, it is their responsibility to request one from a member of staff.
  8. To enter, individuals must then scan the QR code, follow the prompts to the promotion entry page, input the requested details and submit the fully completed entry form during the Promotional Period.
  9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the number of Eligible Products purchased in excess of two (2) in the Qualifying Transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) only one (1) entry permitted per person per day.
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. The draw will take place at 3 Amy Close, Wyong NSW 2259 on 01/05/2024 at 1:00pm AEST in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by email and phone within two (2) business days of the draw. The winner will be published online at ccpromotions.com.au/camping on 03/05/2024.
  14. The Promoter’s decision is final and no correspondence will be entered into.
  15. The first valid entry drawn will win a trip for two (2) adults to Vancouver, Canada valued at up to AU$16,350 depending on date and point of departure. Prize includes:
    • 2 x return economy airfares from the winner’s closest Australian state capital city to Vancouver, Canada (including all airline and airport taxes) valued up to AU$7,000;
    • Return private transfers to/from Vancouver airport and accommodation in Vancouver valued up to AU$400;
    • 1 x night pre-tour accommodation in a minimum 4 star property (twin or double occupancy) in Vancouver valued up to AU$350;
    • 12 x day "Real Canada" Hike and Camping guided tour valued up to AU$7,580. Inclusions:
    • Day 1: 1 night accommodation in Vancouver
    • Day 2: 1 night camping in Kamloops
    • Day 3: Mt Revelstoke National Park, home of the world's only inland temperate rainforests then continue on to Lake Louise. 1 night camping in Lake Louise
    • Day 4: Drive through Yoho Nation Park and Banff National Park. Go Canoeing on Lake Emerald or walk through Takkakaw Falls. 1 night camping.
    • Day 5: 1 night camping in Banff National Park
    • Day 6: 1 night camping in Lake Louise
    • Day 7: 2 nights camping in Jasper National Park
    • Day 8: Jasper National Parl - optional activities include sky tram, bike rental.
    • Day 9: 1 night camping in Wells Gray Provincial Park with hiking activities.
    • Day 10 & 11: 2 nights’ camping in Whistler with hiking and lookout options.
    • Day 12: Head back to Vancouver.
    • One (1) night post-tour accommodation in a minimum 4 star property (twin or double occupancy), in Vancouver valued up to AU$350; and
    • Comprehensive international travel insurance (subject to all travellers having no pre-existing medical conditions and being under 59 years of age) valued up to AU$670.
  16. Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the “Real Canada” Hike and Camping guided tour from 04/08/2024 until 19/09/2024 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods. The prize must be booked within two (2) weeks from the winner claiming their prize.

  17. The winner and their companion must depart from and return to the same departure point and travel together including staying in the same accommodation. For clarity, travel companion must be aged 18 years or over.
  18. Itinerary to be determined by the Promoter in its absolute discretion.
  19. Frequent flyer points will not form part of the prize.
  20. Prize is subject to the standard terms and conditions of individual prize and service providers.
  21. The winner may be required to present their credit card at time of accommodation check in.
  22. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  23. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
  24. Subject to the unclaimed prize draw clause, if for any reason the winner does not redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  25. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  26. Total prize pool value is up to AU$16,350.
  27. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  28. A draw for the prize, if unclaimed, may take place on 15/05/2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within two (2) business days of the draw and their name will be published online at ccpromotions.com.au/camping on 17/05/2024. The unclaimed prize draw winner must claim their prize by 11:59pm AEST on 29/05/2024.
  29. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.
  34. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.beamsuntory.com/en/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
